The plain-English terms under which we sell to you — prices, lead times, returns, warranty, liability.
These terms apply to every order
By placing an order with J & M McEwen, whether online, by phone, or in our showroom at 76 Junction Rd, Kirkwall, Orkney Islands KW15 1AR, United Kingdom, you agree to these terms. They sit alongside your statutory rights as a consumer in the United Kingdom and do not affect them.

Placing an order
An order placed online or by phone is an offer to buy, not a contract. The contract is formed when we email you a confirmation that the goods have been allocated and are being prepared for delivery. We may decline an order at our discretion — for example, if we have made a pricing error, if the item is out of stock, or if we cannot verify your identity for an anti-fraud check.
Pricing
Prices are shown in pounds sterling (£) and include VAT at the prevailing UK rate. Delivery is charged at the rate shown at checkout for your address; for some larger items we may quote bespoke carriage separately.
Pricing errors
We try hard to keep prices accurate, but with thousands of lines errors can happen. If we spot a mistake before the goods have been despatched, we will email you the correct price and give you the option to confirm at the new price or cancel for a full refund.
Stock and lead times
Where we show a lead time it is our best estimate at the time of order, working from supplier data. If a lead time slips materially we will tell you as early as we can and give you the option to wait, switch to an in-stock alternative, or cancel.
Bespoke and made-to-measure
Bespoke orders — custom dimensions, customer's own fabric, configurations not held as stock — require a deposit and cannot be cancelled once production has started, except where the item is defective. We will confirm specification, deposit and expected completion in writing before we start.
Cancellation & returns
For online and phone orders you have the statutory 14-day right to cancel — see the returns & refunds page for the full process. In-store purchases do not carry an automatic right to return for a change of mind, but we will always do our best to help.
Warranty
All new goods are covered by our standard 12-month warranty, in addition to your statutory rights under the Consumer Rights Act 2015. Many ranges carry longer manufacturer warranties — see the warranty policy.
Delivery, risk and title
Risk in the goods passes to you on delivery. Title (ownership) passes once we have received cleared payment in full.
Liability
Our liability is limited to the price you paid for the goods, except where the loss is caused by our negligence or where the law does not allow limitation (for example, death or personal injury caused by negligence).
Force majeure
We are not liable for delays caused by events outside our reasonable control — ferry cancellations, severe weather, supplier failure, strikes, public emergencies.
Disputes
These terms are governed by the law of Scotland and any dispute is subject to the non-exclusive jurisdiction of the Scottish courts.
